New Dundee Love Thy Neighbours Badge featuring Homer and Bart Caniggia disagreeing about club loyalties. As usual this badge is limited in number and sure to sell out. Can be purchased on Ebay under item number 150836722150. I will also be at Lancaster Cove Rangers, the Derby and Brechin. All proceeds to Dundee FC

@stephen borland: Why do you insist on "editing" your posts when you're not making any changes to them?

Twillardo (Dundee Mad badge seller extraordinaire), are you Stephen Borland in disguise or is this the start of a new bromance!

I'm not a lawyer but I think the badges are OK under the fair use (parody) aspect of copyright law (even when done for profit).

unless there has been a legal agreement with Fox and stephen then I would think so.

Fox own the names and image of Homer, Bart etc.

More worryingly, if (and I can only say 'if' as Stephen would need to clarify things), if it is in breach of copyright then it also falls foul of 'commercial gain' as it is being used to make money.

Even more worryingly, this money is being given to Dundee!

Question: has this all been clarified with Dundees legal guys? are they aware that money is being made out of 3rd party commercial images? is the Club ok with this?

Its just a hunch but I think Fox legal people would be interested in discussing that e-bay page with Stephen and indeed a chat with Dundees legal people on the monetary gain.

Just sayin'

indeed, so long as its legal, eh? thats not negative vibes but a concern around money going in to the accounts of this Club. If this is all done by the book, great. Otherwise I will raise my concerns until someone says its ok. So, is it ok? does it come under 'parody' laws or is it a straight lift and a clear infringement of Fox copyright and commercial gain? with implications for Dundee.

Tell you what, send the link you have on e-bay to Fox and ask them what they think. Shouldnt be a problem.
